Massachusetts Question 8 Explained: What It Means for Legal Cannabis in 2026
This November, Massachusetts voters will face a question that could undo nearly a decade of progress: Question 8, a ballot measure that would repeal the state’s legal, regulated adult-use cannabis industry, along with the right to grow cannabis at home.
Here’s what happened, what’s on the line, and most importantly, what you can do about it.
How did we get here?
Massachusetts voters legalized cannabis back in 2016 by a margin of 54%. Today, Massachusetts’ regulated adult-use cannabis industry supports roughly 18,400 full-time jobs across all license types (Leafly Jobs Report). In fiscal year 2025 alone, adult-use sales and excise taxes generated about $290 million for the Commonwealth, on top of nearly $20 million more in licensing fees and fines (MA CCC). That money helps support the Bureau of Substance Addiction Services, municipal police training, the Prevention and Wellness Trust Fund, and appropriations for the MBTA and public-school building projects.
In 2025, a group called the Coalition for a Healthy Massachusetts filed a petition, “An Act to Restore a Sensible Marijuana Policy,” aiming to repeal the state’s laws legalizing, regulating, and taxing adult-use cannabis. The petition gathered enough signatures to go before the Legislature, got a public hearing in March 2026, and then sat without action when lawmakers let their deadline pass. That sent it toward the ballot. After the state’s highest court allowed the petition to proceed and a final signature challenge was rejected in July, it was officially certified: Question 8 will appear on the November 3, 2026 ballot.
It’s worth knowing that the campaign backing repeal has been funded largely by an organization that does not disclose its donors, and reporting has found that many people who signed the original petition say they were not told it was about repealing legal cannabis.
What would happen if it passes?
Question 8 would not touch medical cannabis, that program would stay intact. Personal possession limits would also remain legal for adults. But regulated, licensed adult-use cannabis and home cultivation would be eliminated entirely. That means every retail shop, delivery service, and cultivation operation built under the current system could be forced to shut down, along with the tax revenue, and thousands of jobs that come with it. Massachusetts would become the first state in the country to repeal adult-use legalization if voters approve it.
What can you do?
This comes down to turnout. Recent polling suggests most Massachusetts voters oppose repeal, but only if they actually show up and vote. Here’s how to make sure your voice counts:
- Register to vote by October 24, 2026. You can register online, by mail, or in person (at your local town clerks, election commission, and Boards of Registrars) – the deadline is the same across all three methods.

- Vote NO on Question 8 on or before Tuesday November 3, 2026 – Election Day. Early voting and mail-in ballots are also available if you’d rather vote ahead of time.
